  1. Introduction

    This data protection declaration is intended to inform users of this website and customers of the English Exam Center (including users of our online shop, exam candidates and schools) about the type, scope and purpose of the collection and use of personal data by the operator of the English Exam Center website ("English Exam Centre or We"). This statement may be updated from time to time. We recommend that you check this statement regularly to ensure that you are aware of and accept any changes.

    The English Exam Center takes your privacy very seriously and treats your personal data confidentially and in accordance with applicable legal regulations. As a Portuguese company that essentially offers its services to clients residing or hosted in Portugal, the English Exam Center is subject to the General Data Protection Regulation 2016/679 and the respective implementing regulations, which are periodically amended.

    The use of this website is governed by the policy indicated below and which the user undertakes to fully respect. The user must not use this website if he does not agree with this policy.

  3. Why do we process personal data?

    English Exam Center collects, uses and transmits your personal data only and only if permitted by law or if you agree to the collection and use. We will not use or share your personal data for any purpose that is not described in the following sections.

    As a general rule, we will use your personal data to process your contact (in person, by telephone or by email), to improve the quality of products or services, for the purposes of technical administration of exams and development of our website, and for the maintenance of the address data of persons/entities with whom we maintain business relationships.

    Personal data contains information that allows you to be identified and that can be traced back to you, such as your name, email address, telephone number and IP address.

  4. Data Collected and Use of Data

    1. All site users

      The English Exam Center collects information from all users regarding access to the site and saves them as "server log files". The following data is recorded in this way:

      • Site visited
      • Access time
      • Amounts of data sent in bytes
      • Source/reference from which you arrived at the page
      • Browser used
      • Operating system used
      • IP address used

    2. Users who provide contact information as well as online store users

      If you contact the English Exam Center via the contact options available on the website, or if you make use of our online shop, additional details may or will be stored. In this context, the English Exam Center may additionally collect the following personal data:

      • Name
      • Contact information including email address and phone number
      • Demographic information such as your address, date of birth and gender
      • Other information relevant to surveys and/or offers

      The English Exam Center may use this data for the following purposes:

      • Process and answer your questions
      • Maintenance of internal records, registration for exams and dispatch of materials (books/certificates, etc.)
      • Improvement of our products and services
      • Marketing and market research (see the corresponding section below)

    3. Exam Candidates

      The English Exam Center acts as an exam manager and exam center for different examination bodies including, but not limited to, Cambridge University Press & Assessment at the University of Cambridge, UK (collectively "Exam providers"). If you are an exam candidate or a school enrolling candidates your personal data will therefore be used and shared across borders (i.e. in the case of CUPA between Portugal and the UK for example), between the English Exam Center as your center and the Examination Provider (its employees and agents respectively) for the purpose of administering the examination. This process includes processing registrations and exam results, correction, issuing certificates, processing result inquiries and investigating cases of non-compliance with regulations etc. in particular, forward your personal data to the responsible person within these institutions to respond to or process your enquiry. In addition, the English Exam Center may use your personal data for marketing and market research (see corresponding section below).

      Please note that exam providers may be subject to different data protection laws and may have different data protection standards than the English Exam Centre. Exam providers may also collect additional personal data and may use that personal data for additional purposes not described here (including exam provider-specific marketing, research and quality control). Exam candidates should therefore additionally consult the privacy policies and/or data protection statements of the relevant exam provider, as well as the terms and conditions of the respective exam for further details.

      Regarding Cambridge University Press & Assessment specifically, candidates who take a Cambridge English exam may also be required to have their photo taken on test day. By enrolling for a Cambridge English exam, you acknowledge that your photo may be taken and then sent to Cambridge Press & Assessment. At this point the image is deleted from our database and in controlled by Cambridge Press & Assessment. You can read their Privacy notice here.

  5. How is personal data collected?

    In general, personal data is collected when subscribing to one of our products or services, and some of the personal data are mandatory for the provision of the service.

    We also collect your data when you subscribe to newsletters, to respond to your messages and requests for information, to analyze and formalize your application as a partner or collaborator, for website operations and management, for fraud prevention and to keep track of your contact details.

    We always respect your right to privacy and do not collect any personal information about you without your prior and explicit consent. Your personal data will not be reused for other purposes that are previously identified or that are unrelated to those purposes for which they were initially collected.

    However, the provision of incorrect or inaccurate data is your sole responsibility.

  6. Children's data

    The English Exam Center does not request any information from persons under the age of 18 if it becomes aware of this fact without the prior consent of the person responsible for the child or, in the case of block enrollment by a school, without the school has that same consent. If we become aware that information has been collected without proper authorization, it will be deleted immediately. If you believe that it is possible for us to be in possession of a minor's information without the consent of the responsible person, please contact us.

  7. Sensitive Data

    We expressly request that you do not send us or make us aware of any sensitive personal data, i.e. information that reveals racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic information or relating to a natural person's sex life or sexual orientation. Such personal data will be immediately deleted.

  8. What is the retention period for personal data?

    The English Exam Center stores the affected person's personal data only for the period necessary to achieve the purpose of storage or that is permitted or prescribed by the exam provider and regulatory bodies. If the purpose of data storage no longer applies or the period prescribed by law or regulation expires, personal data is routinely blocked or deleted in accordance with statutory regulations.

    All data and documents required for accounting purposes are stored until the end of the statutory preservation period (ie 10 years in Portugal). Personal data collected for marketing purposes are deleted as soon as the purpose of the activity has been fulfilled or at the request of the individual concerned. Other data are stored for as long as necessary for the performance of the contract and the safeguarding of the English Exam Centre's rights. Exam candidates should note, however, that information that may later be required to confirm and verify results will be retained for an unlimited time.

  9. Rights to access, rectify, update and remove data

    Pursuant to the applicable legislation, you are guaranteed, as the data subject, the right, at any time, to access your personal data, request its correction or addition, oppose the processing of data, with the exception of those strictly necessary to provide the service and/or request data portability, request the deletion of your data for marketing or telemarketing purposes or inclusion in subscriber lists and information services. Unless your request conflicts with the English Exam Center's legal obligation to store data (e.g. statutory retention periods) and with the exception of information that may later be needed to confirm and verify the results of exam candidates , you have the right to have incorrect data corrected and your personal data blocked or deleted.

    If you ask us to delete some or all of your personal data, some of the services requested may not be provided to you, keeping the personal data necessary for the fulfillment of your legal obligations.

    We reserve the right to request access to identifying elements of the author of the request in order to prove their identity.

  10. Disclosure of information to third parties.

    We do not sell or trade your data.

    As part of its activity, we may use third parties to provide certain services, which may imply access by these entities to personal data of our users and customers. When this happens, we take all appropriate precautions, contractually imposing on these entities to put into practice the appropriate technical and organizational measures to prevent any illicit processing of data and to ensure its availability, integrity and confidentiality.

    Personal data may also be made available to the courts and other competent authorities, in strict compliance with the provisions of the law, namely when they prove necessary for the resolution of disputes related to invoicing and for activities related to the protection of public safety, defense and security of the State and the prevention, investigation or detection of criminal offenses.

    Ensuring the confidentiality, integrity and availability of data is a commitment we make to all our customers and users.

    In this sense, we follow the best information security management practices, requiring our employees to strictly comply with the strict standards, ensuring the security of personal data that are communicated to us, not being able to use such data for any other purposes than the defined in the contract, nor correlate them with other data that are available.

    Remember that the Internet is generally not a secure environment. Although all English Exam Center data storage is encrypted, unauthorized third parties will be able to view and manipulate information sent over the Internet. Complete protection against such access by third parties is not feasible. Please keep in mind that data sent over the internet may leave and be transferred to a country where data protection requirements are less stringent than the country where you reside, even if the sender and recipient are in the same country. In this context, English Exam Center assumes no responsibility for the security of your data while it is being transmitted to us via the Internet. We ask that you use other means of communication if you consider it necessary for security reasons.

  12. Cookies

    We use cookies on this website. A cookie is a small text file that identifies your computer on our server. Cookies themselves do not identify the individual user, only the computer used. Cookies are not used to collect personal information.

    If and to the extent you provide us with an email address, the English Exam Center may periodically send you reminders of sessions you have registered for or indication of future sessions if you have not completed your registration, promotional emails about new products, special offers or other information that we think you might find interesting. From time to time we may also use your information to contact you for market research purposes. This contact can be made by email, phone or post. We may also use the personal data you provide to customize the site according to your interests.

    The English Exam Center may contact you for these marketing purposes unless you notify us that you no longer wish to receive marketing communications (e.g. by email to exams@englishexamcentre.pt). Your consent to the use of your personal data for these purposes is voluntary and if you refuse your consent your visit and use of the website will not be affected.
